Communiqué d'AMDH concernant Mohamed Erraji Le Bureau central de l'Association Marocaine des Droits Humains se solidarise avec le bloggeur Mohamed Erraji et désapprouve la sentence injuste prononcée à son encontre et revendique sa relaxation Le jeune Mohamed Erraji, l'un des bloggeurs marocains, a été arrêté le vendredi 05 septembre 2008, à la suite de sa publication d'un article intitulé « le Roi du Maroc encourage le peuple à adopter la culture de l'assistanat ». Sa famille n'a été avisée de son arrestation qu'après son transfert à la prison grâce à l'appel téléphonique d'un détenu. En outre, il a été présenté devant le tribunal, le lundi 08 septembre, sans lui permettre d'être assisté par un avocat pour être condamné à une vitesse record ne dépassant guère quelques minutes, à deux ans de prison ferme et une amende de 5000 dirhams pour « manquement au respect dû au roi », accusation comptant parmi celles figurant dans le registre de l'atteinte aux valeurs sacrées. Après la lecture de l'article en question et du rapport de la section de Chtouka-Aït Baha, la région de résidence de Mohmed Erraji, le Bureau central considère que : - L'arrestation de Mohamed Erraji est une arrestation arbitraire et une violation grave du droit à la liberté d'expression et à la liberté de la presse. - Les conditions où s'est déroulé le procès de Mohamed Erraji confirment le non-respect des conditions et des garanties nécessaires à un procès équitable. - Ce procès est, de nouveau, l'illustration catastrophique de la Justice au Maroc et un autre procès ridicule qui s'ajoute aux dossiers des procès d'opinion en invoquant l'atteinte aux valeurs sacrées. Le Bureau central déclare ce qui suit : - Sa solidarité avec Mohamed Erraji comme détenu d'opinion en revendiquant sa libération immédiate et sans conditions. - Sa condamnation de la sentence injuste et dure prononcée à son encontre dans le cadre du procès injuste violant les droits du prévenu d'une manière flagrante. - Sa revendication pour mettre un terme aux poursuites pénales, aux procès pour délit d'opinion et la libération de tous les détenus politiques. - Sa revendication pour une réelle réforme de la justice à même de garantir son indépendance, sa probité et sa compétence ce qui exige sa reconnaissance comme pouvoir indépendant dans le cadre d'une Constitution démocratique afin qu'elle joue son rôle dans la protection des citoyens contre l'injustice. Qu'elle ne soit pas un instrument légalisant les pratiques arbitraires de l'Etat Le Bureau central de l'Association appelle tous les démocrates et les défenseurs de la liberté d'opinion et de la presse pour la mobilisation dans le cadre de la solidarité avec le jeune Mohamed Erraji et la revendication de sa libération et lance un appel aux avocats parmi eux pour le soutenir devant la cour d'appel. His family hasn't been notified of his arrest until his transfer to prison through the telephone call from a prisoner. Furthermore, he was presented in court on Monday, September 08, without allowing him to be assisted by a lawyer to be sentenced at a speed record just over a few minutes, to two years' imprisonment and a fine of 5000 dirhams for "failure to respect due to the king", an accusation among those listed in the register of committing an outrage to the sacred values. After reading the article in question and the report of the section of Chtouka-Aït Baha, the region of Mohmed Erraji residence, the Central Bureau considers that: - The arrest of Mohamed Erraji is an arbitrary arrest and a serious violation of the right to freedom of expression and freedom of the press. - The conditions in which Mohamed Erraji trial took place confirm non-compliance with the conditions and guarantees necessary for a fair trial. - This trial is, again, a catastrophic illustration of Justice in Morocco and another ridiculous trial in addition to records of trials of opinion by invoking outrage to the sacred values. The Central Bureau states the following: -- His solidarity with Mohamed Erraji as a detainee of opinion by claiming his immediate and unconditional release. -- His condemnation of the unjust and harsh sentence pronounced against him in the trial unfair violating the rights of the accused in a flagrant manner. -- His claim to put an end to the prosecution, the trial for crimes of opinion and the release of all political detainees. -- His claim for a real reform of the judiciary to guarantee its independence, probity and competence which requires its recognition as independent power under a democratic constitution so that it plays its role in protecting citizens against injustice. And that it mustn't be an instrument legalizing the arbitrary practices of the State. The Central Bureau of the Association calls on all democrats and defenders of freedom of opinion and the press for mobilization in the framework of solidarity with the young Mohamed Erraji and claims his release and appealed to lawyers among them for his support when he will be presented to the court of appeal.
